Town Hall Meeting at 8:45 a.m.

All five commissioners, County Clerk Angela Blount, and County Attorney Rob Morton were present in the meeting. County Manager Brandon Rogers is on military leave until the 21st.

e. County Attorney Report to Commissioners

County Attorney Rob Morton advised that he is working on litigation. He also said that he drove on Kings Road on Memorial Day and there was no signage out there. It caused him to go a different way home.

8. UNFINISHED BUSINESS

a. Discuss purchase of 2021 Leeboy Paver and 2021 Sakai Combination Roller and related financing.

Chairman Briar Johnson advised that the cost is $276,000 for new equipment. $130,000 from Yancey for the old equipment and $157,000 for the loan brought the loan to $10,827.99 over the total cost. United Bank advised to apply this $10,827.99 to the principle. There wasn’t a specific number when this was recommended so that is why there is a little extra in the loan.

Motion to approve. Approved 5-0.

11. EXECUTIVE SESSION

Motion to go into Executive Session at 9:09 a.m.

a. County Attorney requests Executive Session for consultation with the county attorney, or other legal counsel, to discuss pending or potential litigation, settlement, claims, administrative proceedings, or other judicial actions brought or to be brought by or against the county or any officer or employee or in which the county or any officer or employee may be directly involved, as provided in O.C.G.A. §50-14-2(1), germane to potential litigation.

Motion to go back in Session at 9:54 a.m.

County Attorney Rob Morton said that there was no action to be taken from Executive Session but wanted to clarify that while the county manager is out, he asked the Chairman to cover things. Our County Code says that in the interim between regular meetings, the Chairman handles business with that authority being subject to confirmation of the commissioners. Chairman Briar Johnson asked if Rob would assist based on section B in the code of ordinance below.

Morton asked for a motion for the Chairman to act with Morton’s assistance based on an ok from the commissioners and stressed that nothing will take place outside of our ordinances.

He also said that the plat situation will be taken care of tomorrow. [Note from the Editor: More on that after the meeting since I was not there when Steve Reeves spoke before the meeting.]

Motion to approve 5-0.

§ 30.02 INTERIM BETWEEN REGULAR MEETINGS

The Pike County Board of Commissioners, at its lawful meeting of the Board on September 12, 1979, does resolve:

(A) That all administrative powers of the Board, in the interim between regular monthly meetings, shall devolve upon and be exercised fully by the Chairperson of the Board of Commissioners;

(B) This delegation of administrative authority is based expressly upon the provision that all actions taken under the authority of this section shall be subject to confirmation by the Board of Commissioners at their next regular meeting; provided further that nothing in this section shall affect the conduct or subject matter of any called meeting of the Board.

[Note from the Editor: The following is from questions that I asked after the meeting from both Steve Reeves and County Attorney Rob Morton.]

Steve Reeves spoke to County Manager Brandon Rogers before he left on military leave and shared a concern about a minor subdivision plat that he was working on. The concern was because of the lack of an Zoning Administrator after Brad Vaughan left his position for Meriwether County and before Jeremy Gilbert began working in Pike County as the Zoning Administrator. Reeves asked him to have this done before he left on leave because it wasn’t clear who does the appointing in a situation like this. County Attorney Morton advised that no one was designated prior to the county manager's departure; however, the incoming zoning administrator, Jeremy Gilbert, begins working for the county tomorrow.
