Update on Bicyclist Death: A Plea Agreement Has Been Reached

ZEBULON - A plea agreement has been reached in Pike County Court in the incident which killed 68 year old Henry Wellmaker being struck and killed while riding his bicycle on Hwy. 18. Calvin Guy was driving the vehicle which struck Mr. Wellmaker on May 7, 2015.

Mr. Guy pled guilty to Vehicular Manslaughter in the 2nd Degree. He was sentenced to 12 months probration and fine along with 40 hours of community service. Assistant District Attorney Ben coker advised that the District Attorney's Office met with the family earlier in the week regarding the plea agreement, and that the family and law enforcement involved in the case were present in the courtroom when Mr. Guy was sentenced.

ADA Coker advised that the investigation of this incident showed that Mr. Guy had fallen asleep at the wheel when he struck Mr. Wellmaker with his vehicle. The deputies who responded to the incident reported that Mr. Guy was visibly upset on the scene of the accident and saw nothing on the scene that would have shown that he was under the influence of drugs or alcohol. Mr. Guy voluntarily submitted to a blood test for drugs and alcohol on the scene of the accident.

"Both parties wanted to resolve this as quickly as possible," said ADA Coker. The case was resolved before Judge Tommy Hankinson yesterday afternoon. A civil case is also pending on this incident.

Update on Bicyclist Death: Grand Jury Has Indicted

ZEBULON - The District Attorney's Office presented its findings to the Grand Jury on the collision between a truck and a bicyclist on May 7, 2015. The accident occurred along Hwy 18 toward Concord and bicyclist, 68 year old Henry Wellmaker of Concord, died as a result of the collision.

The Georgia Bureau of Investigation's Crime Lab tested a blood sample from the driver of the truck, Calvin Guy, as part of the investigation on the case and they advised the Pike County Sheriff's Office that there were no substances in Mr. Guy's blood that would have impaired his ability to drive a vehicle.

Mr. Guy was charged for failing to maintain lane with his vehicle, and the evidence was recently presented to the Grand Jury by the District Attorney's Office. The Grand Jury indicted Mr. Guy with a charge of Vehicular Homicide in the 2nd Degree. According to the Pike County Sheriff's Office, a possible contributing factor in this indictment is Mr. Guy admitting to authorities on the scene that he had fallen asleep while driving.

This case will go before Pike County Superior Court in the future.

Update on Bicyclist Death: GBI Crime Lab Results on Driver Are Back

ZEBULON - The Pike County Sheriff's Office responded to a collision between a pick up truck and a bicyclist on May 7, 2015 which killed bicyclist, Henry Wellmaker of Concord.

The driver of the truck has since been identified as Calvin Guy. A blood sample was sent to the Georgia Bureau of Investigation Crime Lab as part of the investigation by the Pike County Sheriff's Office.

According to Major David Neal of the Pike County Sheriff's Office, the GBI Crime Lab results show no substances that would have impaired Mr. Guy's ability to operate a motor vehicle.

The District Attorney's Office will present its findings to the Grand Jury at a later date.

BREAKING NEWS: Collision Results in Death of Bicyclist

CONCORD - Pike County Sheriff's Office Traffic Investigators responded to Highway 18 in the area of Hamilton Road at approximately 1:00 p.m. today. The site was the scene of a collision involving a pick up truck and a bicyclist. The truck was travelling westbound on Highway 18 when it struck a bicyclist that was also travelling in the same direction. The rider of the bicycle was deceased at the scene and has been identified as Henry Wellmaker of Concord.

The investigation is in its initial phase as the Investigators work to determine what caused the fatal collision. Mr. Wellmaker will be transported to the Georgia Bureau of Investigation Crime Lab for an autopsy to be performed. The driver's name is not being released as of yet and no charges have been filed at this time as the investigation continues into the events that occurred.
