c. County Manager Comment

County Manager Report – Landfill process is ongoing with the consultant and the EPD. We are having three wells dug for monitoring the landfill. It is slow going because of the rain, but the contractor is working to fulfill this part of our contract.

The GDOT projects are ongoing for 2018-2021. The Georgia Department of Transportation will be resurfacing 109 East and West between now and spring of 2018. They will also resurface a 12 mile stretch of road between Hwy 18 and Hwy 74 intersection in Molena to Potato Creek in Upson County. CM Hanson said that the Hwy 109 East bridge over Gola Creek is also on the list, but based on previous conversations with GDOT, he doesn't think that it will remain on the list. These projects will be completed over a three year period and Pike County does not have to contribute any funds for this work on these state roads.

He also said that 2018 LMIG dollars have risen by $30,000 in comparison to this year. LMIG is a matching grant program that helps Pike County with our roads.

The county picnic is on Friday. Thank you to the City of Zebulon for allowing us to use their City Park. This is an annual appreciation for our county employees. Commissioner James Jenkins is the "Master Griller" once again this year!

UGA has stepped forward and Pike County will have an agent who will working in Pike County as well as another county. Our current staff will remain and help out.

ACCG sent something out that the county will have to provide cancer insurance for our volunteer firefighters. They are working to provide something for counties around the state. Right now, it's looking like it will could be as low as $300 per year per firefighter. This is a mandate from the state on all counties throughout the state in order to cover all paid and volunteer fire fighters.

A law has been passed on human trafficking in the state so a hotline will be placed all over the state. The state is making a concerted effort to combat this program and requiring the hotline number to be placed in the common areas in county buildings and in restrooms by July 1, 2017.

The County Manager Report advised that the heavy rains have brought down several trees around the county. One from the county right of way fell fell on a house at the corner of Chapman and Arthur Road and damaged the house as well as bringing down a power line. The county has filed a claim for these damages. Additional trees came down on the roadways but thankfully there have been no injuries and those trees have been cleared.

d. Commissioner Reports

District 3 Commissioner Tommy Powers said that people have been calling about muddy roads. but that we have to wait til it dries out to address issues. He also mentioned something about the landfill with covers or gates that he has discussed with CM previously.

District 4 Commissioner James Jenkins asked about Jonathan’s Roost Road. CM Hanson said that the county has had issues with a water leak in the subdivision and just rain in general. They worked with the subdivision and working to widen that section that had stayed wet because of the leak. A couple of more weeks before it's completely done and then patching and LMIG projects Howell and Wilder Roads will be on the to do list. CW Mathews will be doing those two roads.

e. County Attorney Report to Commissioners: None.

9. NEW BUSINESS

a. PUBLIC HEARING: To receive public input regarding SUB17-01 - Elizabeth Strickland Rumble (trustee for the Frank Eakes Rumble Credit Shelter Trust), property owner, and Alan Mobley, applicant, are requesting preliminary plat approval for a new 8 lot subdivision on 170.44 acres from a 256.48 parent tract on Flat Shoals Road. The parent tract is zoned A-R (Agricultural-Residential), with approximately 3555 feet of frontage along the northern side of Flat Shoals Road. The property is located in Land Lot 182 of the 9th Land District of Pike County, Georgia. Parent tract is further identified as Tax Map Parcel Number 031 003.

Planning and Zoning Director David Allen advised that this was before the Planning Commission on June 8. Staff and Planning Commission both recommend approval. This does not involve any new streets and will have individual septic and well systems. Lots run from 10 to 31 acres. Conditions for approval. 1) min 2,000 sq foot homes 2) no manufactured homes allowed. There is an existing cell tower on the parent track, but there are some setbacks that have to be considered for the tower and there is a 1,000 foot radius from the tower that has to be considered for three of these lots.

IN FAVOR:

Betty Rumble wants to sell this property and said that she thinks that this will be good for the county and will bring some nice homes to the county.

OPPOSITION:

None.

Discussion: Question from Tim Daniel about the 1,000 foot provision. Our ordinance deals with new cell towers, but this is an existing tower with a current owner. The intent is to relieve the county of responsibility if the home owner chooses to have a cell tower placed on their property. County Attorney Rob Morton suggested approving this with an additional condition that the county release be signed by property owners on those three lots about the 1,000 foot stipulation.

Motion to approve with stipulations from staff, Planning Commission, and County Attorney. Approved 5-0.

b. PUBLIC HEARING: To receive public input regarding SE-17-04 – Murray P. Boak, property owner and applicant, is requesting a special exception in an A-R zoned district to allow for a mobile camper on the property for recreational purposes, per Section 156.43 (D)(12). The subject property is located off of Alabama Road, and has approximately 767 feet of frontage along the southern side of Alabama Road. The subject property is located in Land Lot 144 of the 8th District of Pike County, Georgia. The total property (Pike and Upson County portions) consists of 136 acres. The Pike County portion consists of 53 acres and is further identified as Tax Map Parcel #097 001 AA.

This went before the Board of Appeals on June 15 and they recommended approval as well as staff. He currently lives in Cumming and would like to utilize his property here. This has been approved in the past.

IN FAVOR:

Pat Boak said that he wants to put in a well, power and septic tank. He plans to build a house there.

OPPOSITION:

None.

Tommy Powers said that he had made some notes and all of his questions had been answered. Motion to approve. Approved 5-0.

c. PUBLIC HEARING: To receive public input regarding Text amendment to Title XV, Land Usage, Chapter 156, Zoning Code, Section 156.26 (J) Administrative Variance, relative to adding certain requirements of manufactured homes for consideration as administrative variance candidates.

This would be something that Planning and Zoning Director David Allen could approve administratively rather than having a full blown hearing before the Board of Appeals. The Board of Appeals has agreed with this rather than doing a full variance meeting on this. The Planning Commission agrees as well.

OPPOSITION:

None.

Discussion: County Attorney Rob Morton said that the Board of Commissioners passes the laws and a final zoning decision has to come before them with a public hearing. There is a distinction between a zoning matter and an administrative matter. There are certain minor deviations that can be handled by Staff because they are following rules already in place rather than making rules.

Tim Guy asked about square footage. There are different requirements for different zoning.

Motion to approve. Approved 5-0.

d. PUBLIC HEARING: To receive public input regarding ext amendment to Title XV, Land Usage, Chapter 156, Zoning Code, Section 156.43 (A) and (B) Permitted Uses, Section 156.63 (A) and (B), Section 156.78 (A) and (B), Section 156.93 (A) and (B), relative to clarifying certain aesthetic and physical requirements for manufactured homes.

This is a response to the one just approved. There have been a lot of changes to the Code over the year and there were some definitions that were left out with Class A and Class B distinctions including use, size, and roof pitch. Class C will remain as a Board decision. This restores distinctions of the various classes of mobile homes.
